Note: please don't forget to verify the business licenses and permits of those you do business with before signing contracts. That seems obvious. However, in real life, some businessmen simply put all their attention on price negotiations and don't even bother to spend time checking after they have seen expensive cars and offices. Or sometimes, in a big company, when contract review and negotiation is handled by several persons, one might take it for granted that someone else will take care of the verification but actually nobody is doing that part. 

 

When international contracts are involved, identifying the truthfulenss of licenses and permits might not be that easy. Some might not be familar with the legal system or don't know where to look. It is not uncommon that sometimes some company finds out that its business partner is not properly registered or even worse, does not exist.When that happens, claiming damages is usually a big headache. 

 

All in all, please be careful with those you sign contract with. Due diligence usually proves to be worthy for your risk control.

 

 

A contract is a written or oral legally-binding agreement between the parties identified in the agreement to fulfill the terms and conditions outlined in the agreement. Contract management or contract administration is the management of contracts made with customers, vendors, partners, and employees, etc.. Contract management includes negotiating the terms and conditions in contracts and ensuring compliance with the terms and conditions, as well as documenting and agreeing on any changes or amendments that may arise during its implementation or execution. It can be summarized as the process of systematically and efficiently managing contract creation, execution, and analysis for the purpose of maximizing financial and operational performance and minimizing risks.
